Paul Huebner Serial Spitter

Another Crown Heights resident was rushed to the emergency room for treatment after being spat at in the face by serial spitter Paul Huebner.

The incident occurred at or about 1:30pm Saturday afternoon as a Crown Heights resident, a father to young children was heading back home  from synagogue.

As the father was minding his own business and conversing with his children he asked them “do you want to know what a Mosser/rat looks like?”, when all of a sudden out of nowhere this man, he later learns is serial spitter Pual Huebner approaches him, coughs up a whole mouth of  mucus and saliva and like a pro took  aim straight for  his face.

WIS has learned that this is not the first time the Mosser Paul Huebner YM”S has used this tactic.

Simchas Bais Hashava of this year the serial Spitter Paul Huenber actually blinded one victim in one eye.

Huebner has gained a spitting reputation, as one victim says “if he does not succeed in taking you down with a vicious Mesiras – blood libels and lawsuits, you better be prepared to drown in his venom.”

Another victim was quoted saying “It would be one thing if the very least it was Kosher saliva, but having a goys non-kosher spit on ones face is another thing.”

Some victims of the serial spitter  have described how getting spat on by Paul Huebner was far worse then  getting sprayed by a skunk.

A  tale is told in which a community leader found the identity of a thief by gathering the town and saying that he sees the thief’s hat burning, and then observing the real thief feeling his hat with his hands.

And thus we have the expression…

    Huebner is very frustrated, nothing he did or is doing is succeeding in anyway.

    He lost in the Shomrim Six Mesira and he will loss even bigger in the lawsuit. His Mosser friend Gangster Poltorak lost big time in this past elections.
    He never won a case in his life, all he does is sue people and worse just other Yidden.

    A guy like this must be ran out of town!

    Rabbi Feinstein, Iggrot Moshe Chosen Mishpat, 1:8 writes:

The question is can one inform on him to the secular authorities who will judge him severely with either a fine or prison, or must the rabbis judge him according to Jewish law? In my opinion, even though his sin is great, and he shows no repentance, nonetheless so long as we cannot say that the Jewish judges cannot judge him, one may not turn the matter over to the secular authorities…In addition, since it is certain that the secular authorities will adjudicate the matter through incarceration or a fine inconsistent with Jewish law, one must be fearful of the prohibition of informing, as it is prohibited to inform on a Jew to the secular authorities, whether through danger to his body or his money, even if he be a sinner.

    Rabbi Feinstein, Iggrot Moshe Orach Chaim 5:9(11) writes:

    It is prohibited for us to inform on a person for a matter where the punishment is unfounded in Jewish law. In Jewish law, theft is resolved through restitution as measured by an expert, and secular law punishes through imprisonment, unfounded in Jewish law.

    Just as in other areas of halachah, one should consult a competent moreh horaah when faced with such a shayla. Just because one is knowledgeable in Yoreh Deah vol. I or one delivers a good pilpul shiur on sugyos in Nashim or Nezikin, it does not necessarily follow that that individual will be qualified to pasken on hilchos mesirah – lehakel or lehachmir.

    Assault
    An assault involves:

    Note that an assault can be completed even if there is no actual contact with the plaintiff, and even if the defendant had no actual ability to carry out the apparent threat.     Battery

    A battery is the willful or intentional touching of a person against that person’s will by another person, or by an object or substance put in motion by that other person. Please note that an offensive touching can constitute a battery even if it does not cause injury, and could not reasonably be expected to cause injury. A defendant who emphatically pokes the plaintiff in the chest with his index finger to emphasize a point may be culpable for battery (although the damages award that results may well be nominal). A defendant who spits on a plaintiff, even though there is little chance that the spitting will cause any injury other than to the plaintiff’s dignity, has committed a battery.

    Self-Defense

    A person who is assaulted may use such reasonable force as may be necessary, or which at the time reasonably appears to be necessary, to protect himself or herself from bodily harm. An act of self-defense must ordinarily be proportionate to the threat. That is, if you believe a person is going to spit on you, depending upon the context it may be reasonable to push the person away, but it would not be reasonable to hit the person with a baseball bat.

    A plaintiff may be expected to withdraw from the threat, if possible, before engaging in forcible resistance. However, if the plaintiff is in his own home and the defendant is not a member of the plaintiff’s household, a plaintiff will typically not be required to further withdraw from the threat once the plaintiff has retreated to his own home.

    Provocation

    Words alone, no matter how insulting or provocative, do not justify an assault or battery against the person who utters the words.

      An HIV-positive man with a history of spitting at police officers and biting fellow jail inmates was sentenced to 35 years in prison Wednesday.

      Willie Campbell’s sentence came one day after the same Dallas County jury convicted the 42-year-old of harassment of a public servant for spitting into the eye and open mouth of Dallas Officer Dan Waller in May 2006.

      Was Willie Campbell’s 35-year sentence warranted?
      As Mr. Campbell was being arrested for public intoxication, he began to resist and kicked at the computer screen in the police vehicle, Officer Waller testified during the two-day trial.

      “He turns and spits,” Officer Waller said. “He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with.”

      During Tuesday’s guilt/innocence phase of the trial, Mr. Campbell testified in his defense and offered to enter his feet as evidence to prove he did not kick the squad car’s computer screen, said Aja Reed, a prosecutor who worked on the case.

      On Wednesday, as another Dallas officer testified about Mr. Campbell spitting on him in an unrelated incident, Mr. Campbell jumped up and began yelling at the officer and prosecutors, according to another prosecutor in the case, Jenni Morse.

      “He said to the officer, ‘You’re a liar. You’re all railroading me. I’m an innocent man.’ ”

      Dallas County sheriff’s deputies took Mr. Campbell into custody and placed him in a holding cell, where he listened to the remainder of his sentencing trial. But not before he said to prosecutors, “You’re going to rot in hell,” Ms. Reed said.

      Russ Hendrichs, Mr. Campbell’s attorney, could not be reached for comment Wednesday afternoon. Because the jury found that Mr. Campbell’s HIV-positive saliva was a deadly weapon, he has to serve half of his sentence before he is eligible for parole.

      Officer Waller said he was elated with the jury’s decision.

      “I know it sounds cliché, but this is why you lock someone up, so our streets are safer,” Officer Waller said. “Without him out there, our streets are a safer place.”
